Terms of Service
Last updated: [date to be inserted by counsel]
DRAFT: Counsel copy pending. Do not publish.
1. Who these terms apply to
[Counsel to insert: the agreement is between the operator (the residential service tradie or business entity who signs up) and Tradies Line (legal entity name, ABN/ACN). These terms govern operator use of the Tradies Line service. They do not govern the end-customer who calls the AI receptionist on the operator's behalf.]
2. The service
[Counsel to insert: description of the service as an AI receptionist that answers inbound phone calls forwarded from the operator's personal number, books jobs onto the operator's calendar, or captures structured leads. Reference the in-scope residential service niche from v1-scope.md §3. Confirm the service is inbound-only and English-only at v1.]
3. Pricing and billing
[Counsel to insert: current pricing tiers per v1-scope.md §9. At v1 launch Solo and Teams both sell self-serve with a 7-day free trial, and Enterprise routes to contact-sales. v1-scope.md §9 carries the locked sales-status block.]
- Solo: $129 per month plus GST. Includes 150 voice minutes and 100 transactional SMS per month.
- Teams: $299 per month plus GST, flat rate. Includes 400 voice minutes and 300 transactional SMS per month. Includes a 7-day free trial; card required up front.
- Enterprise: Negotiated pricing. Contact sales@tradiesline.ai.
Voice overage: $0.50 per minute above the included quota. SMS overage: $0.15 per SMS above the included quota. Overage is billed at the end of each monthly period via Stripe.
[Counsel to insert: billing currency, GST treatment, invoicing mechanics, price change notice period, NZD pricing note.]
4. Trial period
[Counsel to insert: Solo and Teams tiers. 7-day free trial with card required up-front. Card is charged on Day 8 at the plan's monthly rate. Operator may cancel before Day 8 without charge. Reference the provisioning timeline: local business number and live AI agent are provisioned at first paid invoice (Day 8 or earlier if "Activate now" is clicked).]
5. Number provisioning and the call forwarding model
[Counsel to insert: the operator's existing personal mobile number stays unchanged. Tradies Line provisions a separate Twilio-provided local business number assigned to the operator. The operator configures conditional call forwarding on their carrier (busy, no-answer, after-hours). The operator is responsible for configuring forwarding correctly; Tradies Line cannot configure the operator's carrier on their behalf. Number porting is not supported at v1.]
6. What the AI does and does not do
[Counsel to insert: the AI answers inbound forwarded calls, discloses it is an AI at the start of every call (per the voice disclosure script), conducts a booking or lead-capture conversation, and confirms a booking via a one-time transactional SMS. The AI does not: provide quotes or technical advice, manage ongoing customer relationships, initiate outbound calls, or handle inbound SMS. Reference the "apprentice rule" from v1-scope.md §6.4: the AI confirms calendar slots but does not judge job feasibility or scope.]
7. Operator responsibilities
[Counsel to insert: operator is responsible for maintaining correct business hours, calendar availability, and forwarding configuration in the dashboard. Operator is responsible for following up on leads captured by the AI. Operator must not use the service for commercial or B2B work, NDIS, aged care, or any purpose outside the residential service trades scope in v1-scope.md §4. Operator must not use the service for unlawful purposes.]
8. Cancellation and refunds
[Counsel to insert: operator may cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period; no partial-month refunds on subscription fees. Provisioning failure refund posture per v1-scope.md §11.6: if number provisioning or agent creation fails after a successful Stripe charge, Tradies Line will either re-attempt provisioning or issue a full refund for that billing period.]
9. Acceptable use
[Counsel to insert: prohibited uses, including any use that violates the Australian Consumer Law, the Privacy Act 1988 (AU), the Privacy Act 2020 (NZ), the Spam Act 2003, or the Unsolicited Electronic Messages Act 2007 (NZ).]
10. Limitation of liability
[Counsel to insert: honest limitation of liability language consistent with the Australian Consumer Law (which cannot be excluded). Reference that the AI may occasionally mishear or misclassify a call, and that Tradies Line is not liable for lost bookings resulting from AI errors beyond what the ACL requires.]
11. Governing law
[Counsel to insert: governing law (Australian state TBD by counsel), jurisdiction, and dispute resolution posture. NZ operators are also subject to NZ consumer protection law where applicable.]
12. Changes to these terms
[Counsel to insert: notice period for material changes (recommended minimum 14 days via email). Continued use after the effective date constitutes acceptance.]
